1. El Problema del Greenwashing en RWA Tokenizados The Greenwashing Problem in Tokenized RWAs

Bajo la Directiva CSRD (Corporate Sustainability Reporting Directive) y el Reglamento de Taxonomía de la UE, las empresas que poseen o tokenizan inmuebles e infraestructuras deben reportar riesgos físicos climáticos y de sostenibilidad con el mismo rigor que sus datos financieros. El Problema del Greenwashing: The Greenwashing Problem: Los informes ESG actuales de activos tokenizados son estáticos, auto-declarados y propensos al greenwashing. Un emisor puede afirmar que un edificio es “eficiente energéticamente” basándose en un certificado de hace 5 años, sin verificar si el activo ha sufrido degradación física, cambios en el uso energético o incumplimientos urbanísticos sobrevenidos. Current ESG reports for tokenized assets are static, self-declared, and prone to greenwashing. An issuer can claim a building is “energy efficient” based on a 5-year-old certificate, without verifying whether the asset has suffered physical degradation, changes in energy use, or subsequent urban planning violations.

Un Perito Judicial Oficial colegiado (PTCE) realiza una inspección in situ del activo, verificando: eficiencia energética real (certificado energético vigente), resiliencia climática (riesgo de inundación, incendio, olas de calor), cumplimiento urbanístico y ambiental, y estado estructural. A Certified Judicial Expert (PTCE) conducts an on-site inspection of the asset, verifying: actual energy efficiency (valid energy certificate), climate resilience (flood, fire, heat wave risk), urban planning and environmental compliance, and structural condition.

Cálculo del ESG Physical Risk Score (EPRS) ESG Physical Risk Score (EPRS) Calculation

El perito calcula el ESG Physical Risk Score (EPRS) (0-100) del activo, cuantificando su nivel de riesgo ESG físico. Un score ≤ 20 indica “Bajo Riesgo ESG” y elegibilidad para reporting sin salvedades. Un score > 50 activa alertas de greenwashing. The expert calculates the asset’s ESG Physical Risk Score (EPRS) (0-100), quantifying its physical ESG risk level. A score ≤ 20 indicates “Low ESG Risk” and eligibility for unqualified reporting. A score > 50 triggers greenwashing alerts.

Anclaje On-Chain con Firma eIDAS 2.0 On-Chain Anchoring with eIDAS 2.0 Signature

El dictamen pericial ESG se firma con Certificado Cualificado eIDAS 2.0 y se ancla on-chain mediante PTVSClaimInjector.sol, creando un vínculo inmutable entre la verificación ESG física y el token. Monitoreo Continuo y Alertas de Degradación Continuous Monitoring and Degradation Alerts

El protocolo PEVS establece re-auditorías periódicas (anuales o ante eventos adversos). Si el EPRS empeora (ej. el activo sufre daños por inundación o pierde la certificación energética), el claim se actualiza on-chain, alertando automáticamente a inversores y reguladores. The PEVS protocol establishes periodic re-audits (annual or upon adverse events). If the EPRS worsens (e.g., the asset suffers flood damage or loses energy certification), the claim is updated on-chain, automatically alerting investors and regulators.
